Rivas Images General Terms

Version 2.3 · Published 9 October 2026 · Current version

1. About these Terms These Terms cover every photography session and wedding you book with Rivas Images. You agree to them when you tick the box at online checkout, or when you sign a Rivas Images proposal. Two other documents sit alongside them: - The booking policy you see and agree to at checkout for an online booking. It sets the retainer, balance, charge date, cancellation and rescheduling rules for that booking. - Your proposal, for weddings and other custom work. It sets that job's price, payment schedule, coverage and cancellation rules. If these Terms and your booking policy or proposal say different things, the booking policy or proposal wins for that booking. Together, these Terms and your booking policy or proposal are the whole agreement for your booking. Texts, direct messages and conversations don't change them. A change counts only when we confirm it by email or in an updated proposal. 2. What we offer Rivas Images offers photography only (no video): - lifestyle portrait sessions for individuals, couples, families, maternity and seniors - boudoir sessions - weddings and elopements - mini sessions, special events and golden-hour "window" sessions - brand photography, such as headshots, when offered in your proposal What's included in each session is shown on its booking page or in your proposal. 3. How booking works - Who can book. You must be 18 or older to book. A parent or legal guardian books any session that includes someone under 18. - Online bookings. You choose a session and a time, read the booking policy, and tick the box to agree to it and to these Terms. Paid sessions are confirmed once the booking retainer is paid. Complimentary sessions are confirmed once you tick the box. - Window sessions. Some sessions are booked by date inside a time window (for example, around sunset). We confirm your exact time before the session, inside the window shown when you book. - Weddings and custom work. We send you a proposal. It's booked when you sign it and pay the retainer it shows. - Your record. We keep a record of what you agreed to: your name and email, the date and time, the booking policy text, the version of these Terms, and the device details your browser sends. We email you a copy. - Electronic signature. Ticking the box is your signature. You agree that we can send you notices about your booking by email. 4. Payments - Online bookings are paid by card (including Apple Pay and Google Pay). Invoices and proposals can be paid by card or US bank account. - Payments are handled by our payment processor. We never see or store your full card number. - The retainer, the balance and when it's charged are set out in your booking policy or proposal. - We don't add card surcharges. - Late payments. An invoice more than 10 days overdue carries a late fee of 1.25% of the overdue amount per month. A returned or reversed payment carries a $35 fee. - Prints, albums and other physical products are taxed where Florida law requires. Tax is shown when you order. 5. Cancelling, rescheduling and weather Your booking policy (or proposal) sets out exactly what happens when you cancel or reschedule, and when a balance is charged or credited. In short: - You can reschedule with reasonable notice, as often as you need. Your new date must fall within 12 months of the original one; after that, the booking is treated as cancelled. - If you cancel, the booking retainer isn't refunded. What happens to anything else you've paid depends on how much notice you give, as your booking policy explains. - Weather. Rivas Images decides whether conditions are safe and workable for an outdoor session. If they aren't, we reschedule you at no charge. We don't give refunds for weather. If a named storm, an evacuation order or a closure affects your session location, we reschedule at no charge, and we hold any automatic balance charge until your new date is set. - If Rivas Images cancels (for example, for illness or an emergency), you choose: a new date, or a full refund of everything you've paid, including the retainer. That choice is everything we owe you for our cancellation. We aren't responsible for other costs, such as travel, lodging, outfits or venue fees. 6. Who photographs your session - The owner leads Rivas Images' sessions and weddings. - A second shooter or associate may join some sessions and weddings. They're independent photographers who work with us under a written agreement that lets us deliver and license their photos to you (section 14). - If your photographer can't attend because of illness or an emergency, we may send another qualified photographer working with Rivas Images. If that doesn't work for you, section 5 applies ("If Rivas Images cancels"). 7. Travel - Sessions in Bay, Walton and Okaloosa counties include travel. Outside those counties, travel is quoted for your session, and the quote is shown before you book. - For a location more than 3 hours away by car, you cover airfare and ground transport for our team, and lodging where it's needed. We agree these with you before you book. 8. Locations, permits and park fees - Rivas Images holds and pays for the permits and insurance we need to photograph on local beaches and in parks. - You pay any park entrance fee for your group, and any fee charged by a private community or venue you choose. If we know a location has a fee, we'll tell you before you book. - Florida state parks close at sundown. State-park sessions finish by closing time, and we don't hold sunrise sessions in state parks. - If you choose a location we haven't arranged, you're responsible for getting any permission it needs, and for telling us about any rules you know of. 9. At your session - Arrival. Your session starts at its scheduled time. If you arrive late, it still ends at its scheduled end time when light, park hours or our next booking require it. If you're more than 20 minutes late without letting us know, we treat it as a no-show: the retainer isn't refunded and the session is rebooked at full price. - Safety. We may pause or end a session if conditions or behavior become unsafe, including harassment of our team. If we end a session because of the behavior of you or your group, we deliver what we captured and no refund is due. - Alcohol and conduct. We may stop photographing anyone who is impaired or uncooperative, and we don't photograph illegal activity. We aren't responsible for photos affected by someone's impairment. - Your group. You're responsible for the people and pets you bring, and for your belongings. A parent or guardian supervises children at all times. - Risk. Sessions take place outdoors, on beaches and jetties, in parks and near water. You decide whether to take any pose or go to any spot, and each adult accepts the ordinary risks of being in those places. Nothing here limits responsibility the law doesn't allow us to limit. 10. Weddings This section applies to weddings and elopements unless your proposal says otherwise. - Your photographer. Rivas Images is the only professional photographer at your wedding. Guests are welcome to take their own photos, as long as they don't block ours. If you hire a videographer, tell us their name at least 2 weeks before the wedding so we can coordinate. - Timeline. Coverage starts and ends at the times in your proposal. Please complete our wedding questionnaire at least 2 weeks before the wedding, so we can plan the day with you. Delays in the day don't extend coverage. Extra time, when we're able to stay, is billed at the rate in your proposal. - Your day-of contact. Name one person who can answer our questions on the day and help gather people for group photos. We coordinate with your planner and other vendors, and take direction from you or your named contact. - Meals and breaks. For coverage over 5 hours, please provide a meal for each member of our team, or allow a 30-minute break. - Venue and officiant rules. We follow the rules of your venue and officiant, such as limits on flash or where we can stand. - Shot lists. We welcome a list of the people and moments that matter most and use it as a guide. We can't promise every shot or every person on it. - Missed shots. We aren't responsible for photos missed because of guests, timeline delays, or venue or officiant rules. 11. Boudoir sessions This section applies to boudoir sessions. - Closed set. Only you, our team and up to one guest of your choosing are present. Hair and makeup artists you book may stay for their part of the session. - No recordings. No one at the session may photograph or record it, including on a phone, so you can relax. - Discretion. Boudoir galleries are delivered privately. We never share a boudoir photo in our portfolio or advertising without your written permission for that image (section 15). - Preparation. We send a preparation guide before your session. Following it helps, but how you prepare is your choice. 12. Editing - You receive a curated, edited set of photos. We choose the best frames and edit their color and exposure. - We don't retouch. That means no skin smoothing, body reshaping or removing objects. - We don't provide RAW or unedited files. - The number of photos varies by session. We don't promise a minimum; any number on a session page is an estimate. - Style. You've seen our portfolio and booked us for that style. Location, light, weather and the people in the photos all shape the result, so we can't promise a particular pose, shot or look. A preference about style, on its own, isn't grounds for a refund or a reshoot. 13. Delivery and your gallery - Your photos are delivered through our online gallery service, not in the client portal. - Portraits are usually ready in about 2 weeks and weddings in about 6 weeks. We'll tell you if yours will take longer. - If any balance is unpaid, we may hold your gallery until it's paid. - Your gallery stays online for 12 months from delivery. Please download your photos and keep your own backups. After 12 months we may take the gallery down and delete our copies. If we still have them, we can restore a gallery for a fee. - Prints and products, when offered, are ordered through the gallery's store, which handles checkout and sales tax. Print and product defects are handled by the gallery store's lab under its own policy; tell us and we'll help. 14. Copyright and your license - Copyright in each photo stays with the photographer who took it: Rivas Images, or a second shooter or associate working with us. Booking or paying for a session doesn't transfer copyright to you, and you may not register copyright in our photos. - Rivas Images grants your license for every photo we deliver to you, whoever took it. We promise we hold the rights needed to deliver those photos and to grant you this license. - Personal license. Once your session is paid in full, you can download, print, share and post your photos for personal, non-commercial use, and so can your family and friends. Personal printing is included. No print release is needed. - Business license (brand sessions). Once paid in full, you can use your photos without limit to promote your own business, on your website, social media and print marketing. You can't resell the photos or use them in advertising for anyone else. - Anything beyond these licenses (selling the photos, contests, licensing them to anyone else) needs our written permission. - Light edits for your own use are fine. Please don't remove our watermark, credit a heavily changed photo to Rivas Images, or use the photos to train AI models. - We love a tag (@rivasimages) when you post, but it isn't required. 15. Sharing your photos in our portfolio and ads - Portfolio. We may share some photos from your session on our website, blog and social media. If you'd rather we didn't, untick the portfolio box at checkout, or email us at any time. We'll stop posting your photos and remove existing posts from our own accounts when you ask. Photos in which no person can be identified, such as rings, décor, details and venue shots, may still be shared. - Only images you approve. You can also ask us by email to share only images you approve. Boudoir images are always handled this way (section 11). - Advertising. We'll use your photos in paid advertising only if you tick the separate advertising box, or give written permission later. - Children. If anyone under 18 is in your session, you confirm you're their parent or legal guardian. Your portfolio and advertising choices are made on their behalf. We never use a child's photo in advertising without a parent's opt-in. - Others in your photos. If you bring guests, please let them know about these choices. If a guest doesn't want to be photographed, tell us in writing before the session or event and point them out to us on the day. 16. Privacy - We collect what we need to book and deliver your session: your name, contact details, session details, your photos and payment details. - Your card is stored by our payment processor, not by us. We see only the card type and the last four digits. - We never sell your personal information. We share it only with the service providers that run our bookings, payments, scheduling, email and photo delivery, and only for those purposes, or when the law requires. - A parent or guardian books any session that includes a child. - You can ask us to see, correct or delete your information. If a data breach ever affects your information, we'll tell you as the law requires. - Full details are in our Privacy Policy. 17. If something goes wrong - We back up every session, but equipment and files can fail. If something goes wrong on our side, we'll offer a free reshoot where possible. - Where a reshoot isn't possible, such as a wedding, we refund a fair share of what you paid, matched to the part of your coverage that was lost. If everything is lost, we refund everything you paid. - Our total responsibility for any claim about a session is limited to what you paid for that session. For weddings, it's limited to what you paid under your proposal. - The reshoot or refund above, up to that limit, is everything we owe you for a problem with a session. - We aren't responsible for indirect or consequential losses. - Nothing in these Terms limits our responsibility for our own gross negligence or intentional misconduct, or anything else the law doesn't allow us to limit. 18. Your responsibility to us You agree to cover our reasonable costs if a claim is made against us because: - you broke these Terms; - a location you chose had rules or restrictions you knew about and didn't tell us; - you asked us to photograph copyrighted material, artwork or a restricted area without the permission it needed; or - someone you brought to the session objects to being photographed after you said they'd agreed. 19. Disputes - Florida law applies. - Please tell us about any problem first; either of us may suggest mediation. - Any lawsuit about your booking or these Terms must be filed only in the state courts located in Bay County, Florida, including small claims court where the claim qualifies. - There is no arbitration. 20. Changes to these Terms We may update these Terms. Each version has a number and an effective date, and earlier versions stay online at their own addresses. The version you agreed to when you booked applies to that booking. A new version applies only to bookings made after it takes effect. 21. General - If part of these Terms can't be enforced. If a court finds that part of these Terms can't be enforced, the rest still applies. - No waiver. If we don't enforce a term once, we can still enforce it later. - Events outside our control. Neither of us is responsible for a delay or failure caused by something outside reasonable control, such as a natural disaster, a government order or a venue closure. When that stops your session, we reschedule at no charge, as we do for weather (section 5). - What continues. The parts of these Terms about copyright, licenses, sharing, privacy, liability and disputes continue after your photos are delivered. - Transfers. You can't transfer your booking to someone else without our written OK. 22.
